CONFERENCE PROGRAMME

Conference Facilitator and Host: Colin Strime - SARIPA Northern Region Chairperson.

GUEST SPEAKER: Dr Frans Cronje - Social Research Foundation. This highly sought-after speaker is a consultant to Fortune 500 companies and governments. Dr Cronje will talk on, inter alia, the current and future South Africa. This is certainly a presentation not to be missed.

IN‌SOLVENCY: Lisa Schäfer-King - Fluxmans Director: Labour Law. All contentious and interesting practical issues that arise in liquidations and business rescues, certainly in regard to matters pending in the labour courts and CCMA prior to the commencement of liquidation and business rescue and similar such issues that arise when business rescue proceedings are converted to liquidation and vice versa. Novel topics not previously raised or discussed will be dealt with.

BUSINESS RESCUE: Advocate Jonny Blou SC. The senior advocate who argued the Reiscor matter, Advocate Jonny Blou SC, will be addressing us on the important aspects of that judgment which affect us on a daily basis in rescues including, but not limited to, the important decisions regarding:
(1) what would constitute an “inappropriate vote” at Section 151 meeting;
(2) whether or not Section 34 of the Insolvency Act applies to sale of the assets and/or business of a company in rescue;
(3) whether Affected Parties are entitled to request the BRP to provide them with confidential information pertaining to a company in rescue.
